1. DEFINITION Card - The SCORE Card Card Issuer - Sports Media Asia Cardholder - Members who register through www.sportsmedia.com.ph site after purchasing the card through official dealers. Merchants - Participating establishments that accept the card The User’s Guide is issued to cardholders and may be amended by the card issuer from time to time without prior consent from the cardholder. 2. THE CARD The SCORE Card is issued by Sports Media Asia to the public who purchases the card in official distribution sites. It is non- transferable The card issuer may suspend or terminate, change the benefits, terms and conditions of use of the card for whatever reason it deems fit. The cardholder agrees to surrender the card upon demand by the card issuer or confiscation by any accredited merchant, In the event of any suspension, termination or confiscation of the card, the card- holder agrees to hold the card issuer free and harmless from any claim, loss expenses, suit or liability whatsoever, arising from such suspension, termination or confiscation. Cardholder is requested to affix their signature at the signature panel found at the back portion of the card. The card issuer and the accredited mercahnts reserve the right not to honor unsigned card and shall not be liable for any failure to identify the card due to non-comliance in affixing the cardholder’s signature. 3. VALIDITY The validity of the card is from January 2010 to March 2011. A new image/color of the new card will be issued upon re- newal. The validity of the meerchants offers may very. Please refer to the brochure or www.sportsmedia.com.ph for complete list of merchants and their offer validity. The validity of the insurance coverage will be one (1) YEAR from the date of online complete card registration on the official SMA website at www.sportsmedia.com.ph. 4. MERCHANTS AND BENEFITS OF THE CARD The card is accepted by participation establisments in Metro Manila. For a complete list of the mercahnts and the details of the discounts/priveleges, cardholders may refer to the user’s guide or log on to www.sportsmedia.com.ph 5. LOSS AND REPLACEMENT OF CARD The security and proper care of the card shall be the cardholder’s sole responsibility. The ssuer is not responsible for replacing the lost cards, but the cardholder shall have the option of getting another card by performing the standard transcation require- ment such by the card issuer, may be reinstated by the latter at its option. Should the cardholder fail to comply with the Terms and Conditions provided herein the right to use the card should be terminated. The cardholder’s conntinued use after its expiry, suspension and termination shall be considered a fraudulent act and will be a ground for criminal action. 6. EXCLUSION OF LIABILITY The card user shall not be liable for any loss, cost, compensation, damage or liability to third party arising directly as a result of any or all of the following: 6.1 Refusal of the card issuer or accredited merchant to allow, accept or honor the card. 6.2 Any delay, interruption, or termination of the card transaction whether caused be administrative error, technical, mecha- nical, electrical or electronic fault, or difficulty or any other reason or circumstance beyond the card issuer’s control (including but not limited to acts of God, strike, labor disputes, fire, discturbance, action of government, atmospheric conditions, lightning, interference or damage by thirdparties or any change in legislation) 6.3 Theft or unauthorized use of the card or loss, costs, damages, or payable to any third party by the cardholder. 7. LIMITATION OF LIABILITY In the event of any action that the cardholder may file against the card issuer, the cardholder agrees that the card issuer’s liability shall not exceed P5,000 or the amount of damages actually suffered by the cardholder, whichever is lower. 8. DISCLOSURE The card issuer shall keep all cardholder information in strictest confidence. The card issuer may, however, obtian, exchange or release information to its associates, affiliates, agents, lawyers,or any such persons as the cardholder deems necessary or as re- quired by the law, rule or regulation. 9. VENUE OF LITIGATION Venue of all suits shall either be at Makati City or any province where a branch of this card issuer is located at the exclusive option of the card issuer 10. NON-WAIVER OF RIGHTS Failure, omission or any delay on the part of the card issuer to exercise its right or remedies under these terms and conditions shall not operate as a waiver. 11. SEPARABILITY CLAUSE Should any Terms and Condition in this agreement be rendered void, illegal or unforceable in any respect under any law, the validity, legality, and enforceability of the remaining terms shall not be affected or impaired thereby. 12. AMENDMENTS The card issuer may at any time and for whatever reasons it may deem proper, amend, revise or modify these Terms and Conditions without prior notice. 13. AGREEMENT The cardholder agrees to be bound by the Terms and Conditions governing the issuance and use of the card upon the cardholder signing on the signature panel at the back portion of the card and by registering, activating and using the card. Should the cardholder disagree with the Terms and Conditions, the cardholder shall cut the card in half. “I UNDERSTAND COMPLETELY THE TERMS AND CONDITIONS STIPULATED ABOVE AND IN THE SCORE CARD MANUAL AND WEBSITE. I DECLARE THAT ALL INFORMATION I HAVE GIVEN ARE TRUE. ALSO, THAT I HAVE READ AND FULLY UNDERSTOOD ALL PUBLIC INFORMATION AND REQUIREMENTS REGARDING MY POLICY / INSURANCE COVERAGE. I DECLARE THAT I HAVE RECEIVED MEDICAL CLEARANCE BEFORE ENGAGING IN ANY PHYSICAL ACTIVITY AND HAD BEEN DECEMED IN GOOD HEALTH/PHYSICAL CONDITION AND I FURTHER ATTEST THAT I HAVE NO PARTICULAR INJURIES TO DATE ARISING FROM ANY PRIOR SPORTS/FITNESS RELATED INCIDENCES. I UNDERSTAND THAT ANY MISDECLARATION OF FACTS MAY AFFECT MY INSURANCE COVERAGE.”
